Terms and Conditions for Newcastle Permanent MyDesign Card Service  

  1. In addition to these terms, our MyDesign Card service is subject to the terms contained in the documents already forming the contract governing the financial product to which your card relates (“Account Terms”). To the extent of any inconsistency between these terms and the Account Terms, the Account Terms prevail.
  2. In these terms, unless a contrary intention is apparent, words which are defined in the Account Terms have the same meaning given to them in the Account Terms.
  3. You must only submit images complying with the image guidelines which we determine from time to time.
  4. We reserve the exclusive right to reject any image submitted or to refuse to issue a personalised card at our absolute discretion including without having to provide any reason.
  5. The fee for a personalised card or replacement personalised card is $15.00 (including GST). This fee will be charged once the image has been approved by us and will be debited to your card account to which the service applies, that is:
    1. in the case of a credit card, to the credit card account;
    2. in the case of a cash card or debit card, to the first account linked to that card.
  6. If your application relates to a card linked to a joint account, you warrant that the other joint account holder/s consent to the application and our processing of same, after them having also read and agreed to these terms and that you do not require us to inform or obtain from them direct their consent to your application.
  7. Your personalised card remains our property. You must immediately destroy it or return it to us if we request this, or if the card or account/s to which it is linked is cancelled or closed.
  8. You warrant that:
    1. you are the owner of the image submitted with your application or, if you are not the owner, you have obtained the consent of the image's owner to use the image on your card;
    2. you have obtained the consent of any person depicted in the image to have that image displayed on the card; and
    3. use of the image by us will not infringe any other person's rights, including intellectual property rights, in the image.
  9. If requested by us, you must provide evidence of your ownership of the image or the image’s owner's consent to your use of the image.
  10. You grant, or you warrant that the image’s owner grants, to us a perpetual, non-exclusive, royalty-free, world-wide, irrevocable licence to use the image and the data you provide to us for the purpose of providing your personalised card to you.
  11. You consent, or you warrant that the image’s owner consents, to us storing, modifying, copying or using the image. You must provide evidence of such consent upon our request.
  12. You warrant that the image does not contain any computer viruses or unauthorised programs.
  13. If we reject the image submitted with your application, you must provide an acceptable replacement image within 5 days of the date the image was rejected, otherwise:
    1. in the case of new credit card applicants, the default credit card design will appear on the card; and
    2. in the case of all other applicants, another application for a personalised card will need to be submitted.
  14. If we reject the image submitted with your application, the image and other data you have submitted may be kept or destroyed by us in our absolute discretion and for which we will not be liable.
  15. You indemnify us against any claims arising or loss suffered by us as a result of the image being used on your card and in respect of us storing, modifying, copying or using the image or us failing to do any of those things.
  16. We are not responsible for poor quality images or images poorly positioned on your card.
  17. To the extent permitted by law, the maximum liability we can ever suffer in relation to any image processing is the resupply or fee charged for supply of this service.
  18. We collect and use your personal information to enable us to provide you with the service you have requested. You consent to us disclosing the image submitted by you and data submitted by you in connection with it, together with your personal information, to any of our employees, agents and service providers who assist us in carrying out any of our functions and activities. Until a participant tells us otherwise, we may also use their personal information (including email address or mobile phone number) to inform them of products and services provided by it, its related entities or alliance partners, which the Society thinks may interest them.   19. To the extent permitted by law, these terms may be varied by us at any time by giving 30 days notice on our website at www.newcastlepermanent.com.au/. You agree that by doing this we have provided you with sufficient notice of the variation.
